Terms of Service

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. By uploading a photo or completing a purchase, you are entering into a legally binding agreement with Glow. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Glow (the "Service") at glow.pirouz.media, uploading a photo, or completing a purchase, you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and the operator of Glow ("Glow," "we," "us," or "our").

If you use the Service on behalf of an organization or company, you represent that you have the authority to bind that organization to these Terms, and the word "you" will refer to that organization.

2. What Glow Is

Glow is an AI-powered photo transformation service. You upload a photo of yourself, and the Service applies artificial intelligence models to generate editorial-style portrait transformations ("Output"). You receive watermarked, low-resolution preview images at no charge before any payment is required. After payment, you receive full-resolution, unwatermarked Output delivered to the email address you provide at checkout.

Output is an artistic AI transformation, not a photographic edit. Results vary based on the quality, lighting, resolution, and composition of your source photo, as well as the inherent variability of AI generation. No specific result is guaranteed. The preview-before-pay model exists precisely because of this variability.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that:

  • (a) You are at least 18 years old;
  • (b) You have full legal capacity to enter into these Terms;
  • (c) Your use of the Service complies with all laws and regulations applicable to you in your jurisdiction.

4. Your Uploaded Photos

4.1 Your Representations.

By uploading a photo to the Service, you represent and warrant that:

  • You own the photo or have all rights necessary to use it for this purpose;
  • If the photo depicts you, you have the right to authorize AI transformation of your own likeness;
  • If the photo depicts any other person, you have obtained that person's explicit, written consent to upload their photo for AI transformation, and that consent expressly covers AI-generated modification of their likeness;
  • You will not upload photos depicting any person under 18 years of age under any circumstances;
  • The photo does not infringe any third party's copyright, trademark, privacy, or other rights;
  • The photo does not contain nudity, graphic violence, or sexually explicit material.

4.2 License to Process.

By uploading a photo, you grant Glow a limited, non-exclusive, royalty-free license to store, process, and transmit your photo solely for the purpose of providing the Service to you. This license terminates automatically when your photo is deleted in accordance with Section 4.3 below.

4.3 Automatic Deletion.

Your uploaded photos are automatically and permanently deleted from our servers within 24 hours of your order being processed. We do not retain, sell, license, share, or use your uploaded photos for any purpose beyond fulfilling your order — including marketing, advertising, or AI model training.

4.4 No Training Use.

Glow does not use your uploaded photos to train, fine-tune, test, or otherwise improve any AI model.

5. Payment

5.1 Fees.

Current pricing is published on the Service. All fees are in U.S. Dollars (USD). Glow offers one-time payment packages only — there are no subscriptions or recurring charges.

5.2 Payment Processing.

Payments are processed securely by Stripe, Inc. Glow does not store your credit card or payment information. By completing a purchase, you also agree to Stripe's Terms of Service (available at stripe.com/legal/ssa). Your billing statement will show "GLOW PIROUZ MEDIA" or similar.

5.3 Taxes.

You are responsible for any applicable taxes, duties, or levies arising from your purchase, beyond any taxes Glow is legally required to collect and remit.

5.4 Chargebacks.

If you initiate a chargeback or payment dispute with your card issuer in connection with a Glow purchase, and we determine the chargeback is not warranted (for example, because a refund was already issued, because you viewed and proceeded past the watermarked preview, or because the Service was delivered as described), we reserve the right to: (a) dispute the chargeback with your payment provider; (b) recover any chargeback processing fees we incur (which are typically $15 or more per incident); and (c) suspend your access to the Service.

6. Delivery

Output is delivered to the email address you provide at checkout. Delivery typically occurs within minutes of confirmed payment. If you have not received your photos within 24 hours of a confirmed payment, please visit our Contact page at /contact with your order confirmation number.

Glow is not responsible for non-delivery caused by: an incorrect email address entered at checkout; your email provider's spam or junk filters; inbox storage limits; or any other condition outside our control. It is your responsibility to provide an accurate email address and to check your spam folder.

7. Refund Policy

See our full Refund Policy at /refund-policy. In summary: we show you a watermarked preview before you pay. If you are not satisfied with your Output after payment, contact us within 7 days of your purchase. We will first offer a free regeneration. If you remain unsatisfied after regeneration, we will issue a full refund to your original payment method. Refunds are processed to the original payment method only and may take 5-10 business days to appear, depending on your bank.

8. Ownership of Output

Once you have paid for and received your Output, you own it. You may use it for personal or commercial purposes, including sharing on social media, printing, and publication. Glow makes no ownership claim to your Output.

Restrictions on Output. Regardless of the above, you may not use your Output to:

  • (a) Impersonate, defame, harass, stalk, or harm any person;
  • (b) Create or distribute non-consensual intimate imagery ("deepfake" content) or synthetic media intended to deceive or harm;
  • (c) Commit fraud or misrepresent your identity in any regulated or consequential context (e.g., legal documents, identity verification);
  • (d) Resell Output as a stock photography product, template, or AI training dataset for commercial redistribution at scale.

9. Intellectual Property

9.1 Glow's Intellectual Property.

The Service — including its software, code, design, branding, website, user interface, and all underlying technology — is owned by Glow and is protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership of Glow's intellectual property to you.

9.2 Copyright Complaints.

If you believe any content on or generated through the Service infringes your copyright, please contact us via our Contact page at /contact with the following information:

  • (a) A description of the copyrighted work you claim has been infringed;
  • (b) Identification of the allegedly infringing material and where it appears on the Service;
  • (c) Your name, address, telephone number, and email address;
  • (d) A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law;
  • (e) A statement made under penalty of perjury that the information in your notice is accurate, and that you are the copyright owner or authorized to act on their behalf;
  • (f) Your physical or electronic signature.

We will respond to valid infringement notices in accordance with applicable law.

10. Third-Party AI Models and Services

The Service relies on third-party AI model providers and infrastructure services (including, but not limited to, fal.ai and Stripe) to process your photos and deliver results. Glow does not own, operate, or control these third-party systems.

You acknowledge and agree that:

  • (a) AI-generated Output may vary widely, may not match your expectations, and may occasionally produce unexpected or imperfect results;
  • (b) Glow is not responsible for the outputs, behavior, limitations, downtime, or errors of third-party AI models or service providers;
  • (c) Glow contractually requires its AI processing providers to use your photo data only to fulfill your order and not to use it for AI training or other purposes.

11. Prohibited Uses

You agree not to use the Service to:

  • (a) Upload photos of any person without their explicit consent;
  • (b) Upload photos depicting any person under 18 years of age;
  • (c) Upload photos containing nudity, graphic violence, sexually explicit material, or illegal content;
  • (d) Create content intended to deceive, impersonate, defame, harass, stalk, or harm any individual;
  • (e) Generate synthetic media ("deepfakes") of any person without their explicit consent;
  • (f) Reverse-engineer, scrape, copy, decompile, or extract the Service's models, prompts, or technology;
  • (g) Resell access to the Service or commercially exploit the Service itself (as opposed to your own purchased Output);
  • (h) Use bots, automated scripts, or other automated tools to access or use the Service;
  • (i) Circumvent or attempt to circumvent the watermarking, payment, or preview systems;
  • (j) Violate any applicable law, including privacy laws, consumer protection laws, anti-spam legislation, or laws governing synthetic media.

Glow reserves the right to refuse service, cancel orders without refund for policy violations, and permanently suspend users who violate these prohibitions, with or without prior notice. Glow may report violations to relevant law enforcement authorities.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GLOW EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

  • ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT;
  • ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • ANY WARRANTY THAT OUTPUT WILL MATCH YOUR EXPECTATIONS, ACCURATELY REPRESENT YOUR LIKENESS TO ANY SPECIFIC DEGREE, OR BE SUITABLE FOR ANY PARTICULAR PURPOSE;
  • ANY WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR QUALITY OF AI-GENERATED OUTPUT.

Some jurisdictions do not permit the exclusion of certain implied warranties. In those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • (a) TOTAL LIABILITY CAP. Glow's total cumulative liability to you for all claims of any kind arising from or relating to the Service is limited to the total amount you actually paid to Glow in the transaction directly giving rise to the claim.
  • (b) EXCLUDED DAMAGES. In no event will Glow be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: loss of profits; loss or corruption of data; loss of goodwill or reputation; business interruption; emotional distress; or any damages arising from your reliance on AI-generated Output — even if Glow has been advised of the possibility of such damages.
  • (c) THIRD-PARTY CAUSES. Glow is not liable for damages caused by: third-party AI model behavior or output; incorrect email addresses provided by you; delivery failures caused by your email provider or spam filters; your violation of these Terms; or events of force majeure as described in Section 16.

Some jurisdictions do not permit the exclusion or limitation of certain types of damages for consumer transactions. In those jurisdictions, the above limitations apply to the fullest extent permitted by law. Nothing in these Terms limits Glow's liability for fraud, willful misconduct, or any liability that cannot lawfully be excluded.

14. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Glow and its officers, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, judgments, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • (a) Your use of the Service;
  • (b) Your violation of these Terms or any applicable law;
  • (c) Your uploaded photos, including any claim that a photo infringes a third party's intellectual property rights, privacy rights, or any other rights, or was uploaded without proper consent;
  • (d) Any Output you create, distribute, publish, or use after receiving it from the Service;
  • (e) Any claim brought by a third party whose likeness appeared in a photo you uploaded.

15. Service Availability and Modifications

Glow does not guarantee uninterrupted or error-free availability of the Service. We reserve the right to:

  • (a) Modify, update, suspend, or discontinue the Service or any part of it at any time, with or without notice;
  • (b) Change pricing, features, or policies with advance notice where required by applicable law;
  • (c) Refuse or cancel service to any user at our reasonable discretion, including for suspected abuse or policy violations.

If Glow permanently discontinues the Service before fulfilling a paid order, we will refund the amount paid for that unfulfilled order.

16. Force Majeure

Glow will not be liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including but not limited to: natural disasters; power outages or failures; internet or telecommunications infrastructure failures; third-party service provider outages (including Stripe, fal.ai, or hosting and infrastructure providers); acts of government; war; pandemic; or other events of force majeure. We will make commercially reasonable efforts to resume performance as soon as possible.

17. Privacy

Your use of the Service is governed by our Privacy Policy, available at /privacy-policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and processing of your personal information as described in that policy.

Transactional emails (such as order confirmations and photo delivery) are sent solely for the purpose of fulfilling your order and do not constitute unsolicited commercial messages.

18. Dispute Resolution

18.1 Informal Resolution First.

If you have a dispute with Glow, please contact us via our Contact page at /contact before taking any formal legal action. We will make reasonable good-faith efforts to resolve your concern within 30 days. Most issues can be resolved quickly through direct contact.

18.2 Governing Law.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

18.3 Jurisdiction.

Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

18.4 Small Claims.

Either party may pursue an individual claim in Ontario Small Claims Court for disputes within that court's monetary jurisdiction, as an alternative to the process described in Section 18.3.

18.5 Consumer Rights.

Nothing in these Terms limits, waives, or overrides any rights you may have as a consumer under the Ontario Consumer Protection Act, 2002, or any other applicable mandatory consumer protection legislation.

19. General Provisions

19.1 Severability.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.

19.2 No Waiver.

Our failure to enforce any right or provision of these Terms on any occasion will not constitute a waiver of that right or provision on future occasions.

19.3 Entire Agreement.

These Terms, together with the Refund Policy and Privacy Policy, constitute the entire agreement between you and Glow with respect to the Service and supersede all prior agreements and understandings.

19.4 Assignment.

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Glow may freely assign these Terms in connection with a merger, acquisition, or sale of assets.

19.5 No Third-Party Beneficiaries.

These Terms do not create any rights for any third party.

19.6 Language.

These Terms and all related documents are written in English.

20. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with an updated "Last updated" date. For material changes, we will make reasonable efforts to provide advance notice. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to updated Terms, you must stop using the Service.
